8. Legal Bases for Processing

Where applicable law requires a legal basis for processing Personal Information, we may rely on one or more of the following legal bases, depending on the context:

Where we process Personal Information on behalf of a Customer or Authorized Partner, the applicable Customer or Authorized Partner is generally responsible for determining the relevant legal basis for its own processing activities.

9. Authorized Partners and Service Continuity

Where your account or Services are made available through an Authorized Partner, we may process and share Personal Information with the applicable Authorized Partner as reasonably necessary to provide, manage, bill, support, secure, transition, or maintain the Services.

This may include sharing account information, contact details, service information, domain information, email service information, billing status, subscription information, technical information, support information, usage information, and other information reasonably required in connection with account management, support, billing, service continuity, legal compliance, operational requirements, or transition of account management.

We do not generally contact customers of Authorized Partners directly as a routine commercial practice. However, we may contact you directly where we determine that such contact is necessary or appropriate in connection with your account, the Services, security, abuse prevention, legal compliance, payment status, domain-related matters, email services, support, service continuity, transition of account management, or protection of the Platform, users, End-Users, Authorized Partners, Third-Party Providers, or any third party.

If an Authorized Partner ceases operating, becomes unavailable, loses authorization, fails to provide service or support, fails to meet its obligations, fails to pay amounts due, is suspended or terminated, or if we determine that action is necessary to protect users, End-Users, the Platform, legal compliance, or service continuity, we may transfer, migrate, assign, or make available relevant account and service information to another Authorized Partner, to Loadweb directly, or to another service structure determined by us, subject to applicable law.

An Authorized Partner may have its own privacy policy and may process Personal Information for its own purposes. You should review the privacy notices and terms provided by the applicable Authorized Partner. We are not responsible for an Authorized Partner’s independent privacy practices unless expressly stated otherwise.

10. AI Tools and AI-Assisted Support

The Services may include tools, features, functionalities, and support services powered in whole or in part by artificial intelligence, machine learning, large language models, generative AI systems, or similar technologies (“AI Services”).

AI Services may be used to generate, create, build, edit, configure, optimize, analyze, or suggest content, websites, applications, digital products, services, projects, workflows, designs, images, code, configurations, functionalities, and other digital experiences or outputs. AI Services may also be used to provide support, assistance, onboarding, guidance, recommendations, troubleshooting, and other services relating to the use of the Platform and our products and services (“AI-Assisted Support”).

Where you are logged into your account, and where reasonably necessary to provide relevant, contextual, personalized, or useful functionality, recommendations, or assistance, AI Services may access, retrieve, scan, analyze, and process information available within or associated with your User Account, websites, applications, digital products, services, projects, workflows, content, generated materials, structures, settings, configurations, integrations, active products or services, features and tools used, account activity, usage information, technical information, and previous requests or interactions.

We may use information processed in connection with AI Services to provide the requested service or functionality, understand your request, provide support and troubleshooting, improve relevance, suggest features or services, prevent abuse, measure performance, evaluate system quality, generate aggregated insights, and improve, develop, test, and optimize the Platform, AI Services, support services, products, features, and user experience.

We may use third-party AI providers, model providers, API providers, cloud providers, infrastructure providers, and other technology providers to provide or operate AI Services. Information reasonably necessary to process a request, generate a response or output, or perform an AI-powered action may be transmitted to and processed by such providers on our behalf, subject to appropriate contractual, confidentiality, security, and data processing arrangements.

Personal Information processed in connection with AI Services will not be used to train general-purpose artificial intelligence models unless otherwise expressly disclosed to you and permitted under applicable law. This does not prevent us from using aggregated, anonymized, de-identified, or otherwise non-identifiable information, usage data, statistics, feedback, performance data, and insights for analysis, testing, development, improvement, and optimization.

If you provide or permit AI Services to process Personal Information relating to your customers, visitors, users, End-Users, employees, contractors, or other third parties, you are responsible for ensuring that you have all rights, permissions, consents, notices, and legal bases required to permit such processing under applicable law.

AI-generated responses, recommendations, suggestions, content, or other outputs may be incomplete, inaccurate, outdated, unreliable, or inappropriate for a particular purpose. Customers are responsible for reviewing, verifying, and adapting AI-generated outputs before relying upon, publishing, implementing, or otherwise using them.

Customers and Authorized Partners are responsible for providing cookie notices, consent mechanisms, opt-out tools, and other disclosures required for cookies, analytics, pixels, marketing tools, tracking technologies, or similar technologies they enable or use in connection with their own websites, applications, stores, forms, campaigns, communications, or digital products.

We may collect and process cookie-related, analytics, advertising, attribution, and usage information relating to Loadweb Sites, the Platform, Authorized Partner activity, Customer activity, and End-User interaction with Customer Digital Products, where required or appropriate for operation, security, fraud prevention, abuse prevention, analytics, service improvement, campaign measurement, personalization, support, legal compliance, or other purposes described in this Privacy Policy.

Where required by applicable law, we will provide or support applicable notices, consent mechanisms, choices, or opt-out mechanisms. You may also manage certain cookie preferences through browser settings, device settings, consent banners, account settings, or other tools made available from time to time. Blocking cookies may affect functionality, security, authentication, preferences, or availability of certain Services.

12. Sale, Sharing, Targeted Advertising, and Marketing Technologies

We do not sell Personal Information in the traditional sense of selling it for money.

However, certain analytics, advertising, marketing, measurement, attribution, remarketing, campaign management, or similar technologies may be considered a “sale”, “sharing”, targeted advertising, or similar activity under some privacy laws.

Where required by applicable law, we will provide applicable notices, choices, or opt-out mechanisms. The availability and scope of such notices, choices, or opt-out mechanisms may depend on your location, applicable law, the relevant service, the relevant website or digital product, the applicable Authorized Partner or Customer configuration, and the technologies being used.

Customers and Authorized Partners are responsible for ensuring that their own use of advertising, analytics, remarketing, tracking, campaign, pixel, or similar technologies complies with applicable law.
